Government reiterates ANATG services regularisation “not feasible”, resume “normal duties”

The Government of Nagaland has replied to All Nagaland Ad-hoc Teacher’s Group (ANATG) – 2015 batch regarding their indefinite agitation in demand of regularisation of their services. Thavaseelan K, IAS, Principal Director, in a letter to the President of the group, dated 26 September 2022, reiterated that the government is restrained from regularising their services by Judicial Orders of Hon’ble High Court.

The aggrieved ANATG-2015 batch had yesterday declared indefinite agitation until their demands were fulfilled. In 2018, the group had protested for nearly a month before suspending their demonstration following the appeasement policy of the state government by granting them scale pay with 6th ROP of 2010. However, the demand for regularisation of the services had remained unfulfilled.

The Principal Director told ANATG-2015 batch, “Writ Appeal No 2016 (K) of 2018 was filed by the State against the Guwahati High Court’s Order dated 0310812018 but was dismissed by the Division Bench on 07/02/2019.”

Moreover, the cabinet had referred the issue to Personnel & Administrative Reforms Department (P & AR) several times and that the latest comment from the department read,

  1. The Hon’ble High Court in its Judgment and Order dated 03/08/2018 passed in W.P. (C) No. 145 (K) 17 directed the State Government not to regularise any person on the basis of mere completion of 03 (three) years of continuous service on contract/ad-hoc basis. The Judgment was subsequently upheld by the same Court in its Order dated 07/02/2019 passed in W.A. No. 16 (K) 2018.
  2. In view of the above said judicial pronouncements, the proposed regularisation of service is not feasible at this juncture.

The government also added that it is seeking legal opinion of the Advocate General, Nagaland and Law and Justice Department, as directed by the Chief Secretary. It therefore requested the 1166 ad-hoc teachers to resume their duties and also warned them with disciplinary actions as per the Nagaland Government-Servants Conduct Rules, 1968.

In a separate press release the government stated that “the period of absence will be treated as Dies-non and the principle of No Work, No Pay will be imposed.”
