In pursuance to the Government notification Vide.No.HFW-22/B-2/2009/250 Dated Kohima the 13th May 2024, the Department of Health & Family Welfare has informed that effective from 1st April 2024, all drugs licensing processes shall be through online portal only and therefore no offline or physical application shall be accepted or entertained. Further, it is also informed to all Licensees that, renewal/retention and all other post approval changes shall be through online and not otherwise.
Therefore, all running Licensed retailers and Wholesalers are also informed to get their firm/business on-board into the under given portal within 3 (three) months from the date of issue of this notice.
In this regard, necessary information and assistance can be sought from district Drug Control Officers in the respective CMO Office.
Whereas, Section- 7 of the Drugs & Magic Remedies (Objectionable Advertisement) Act, 1954 prohibits any person from taking any part in the publication of any advertisement referring to any drug in terms which suggest or are calculated to lead to the use of that drug for,—
- the procurement of miscarriage in women or prevention of conception in women; or
- the maintenance or improvement of the capacity of human beings for sexual pleasure; or
- the correction of menstrual disorder in women; or
- the diagnosis, cure, mitigation treatment or prevention of any disease, disorder or condition specified as given in the Schedule below:-
It further stated that Section -7 provides a penal provision, wherein on conviction, with imprisonment which may extend to 6 (six) months, or with fine, or with both but on subsequent conviction, with imprisonment which may extend to 1 (one) year, or with fine, or with both.
Therefore, in the light of the above legal provision, it is hereby informed to all Print Medias, Publishers, Advertisement Agencies, Social Media users to desist from such publication and promotion or telecast of Drug/Medicine products in contravention to the provisions of the law as provided under Drugs & Magic Remedies (Objectionable Advertisement) Act, and Rules made thereunder.
Strict Legal action shall be initiated against such defaulters.
