The 59 members of the Nagaland Legislative Assembly on Monday, unanimously passed a resolution to repeal ‘The Employment of Manual Scavengers & Construction of Dry Latrines (Prohibition) Act,1993’ and adopted ‘The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013’.
The resolution was moved by Nagaland Chief Minister Neiphiu Rio on the first day of the second session of the 14th Nagaland Legislative Assembly.
The resolution noted that ‘The Employment of Manual Scavengers & Construction of Dry Latrines (Prohibition) Act, 1993’ adopted by the State Government in the year 2008 has now become “redundant” with the enactment of the new Act i.e ‘The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013’.
Informing that the Cabinet has approved for repeal of the Act of 1993, the CM said that the Act of 1993 was enacted by the Parliament under Article 252 of the Constitution and subsequently, adopted by various states. “It’s repeal can be done only as per the procedure prescribed under Article 252 which requires passing of resolution for the repeal of the 1993 Act by the state legislature,” he said.
