Nagaland Police on Wednesday updated that the Department of Military Affairs, Ministry of Defence, Government of India, had refused to give Sanction for Prosecution against all the 30 accused in the killing of civilians at Oting village in Mon district on 5 December 2021.
In a press release, Nagaland Police stated that a Special Investigation Team (SIT) had completed its investigation on 24 March 2022, a case was filed against the accused District and Session Court, Mon on 30 May 2022.
Since then, the Police is seeking for Sanction for Prosecution against the accused from the Ministry of Defence as it is required for ‘initiating any proceedings against security forces personnel for any actions taken by them while discharging their duties under section 197(2) Cr.P.C and Section 6 of the Armed Forces Special Powers Act (AFSPA).’
Nagaland Police also informed that the wives of the accused Security Forces personnel had approached the Supreme Court for a stay of the proceedings in the case, following which the court stayed any further proceedings in the case on 19 July 2022.
On 4 December 2021, 13 civilians, returning home after work, were ambushed and gunned down by the 21 Para Commandos. The following day, one youth was gunned down at the Assam Rifle Mon Hq. The Assam Rifles had opened fire to the youth crowded there, bringing a mournful and unforgettable event in Mon district.
