In compliance to the issue which took place on 16th October, 2023 at Meriema Village, the Zienuoimia Clan belonging to Meriema village having concern about the stress and mental torture among its people is hereby giving this statement.

While giving a thorough study on the issue, it has been brought to our knowledge that the 16th October, 2023 incident took place in regard to the contract work under Nagaland University Kohima Campus Meriema (Letter No: NU/ENG-258/2022-1671 DATED: 23:02:2022).

In regard to the application submitted by the contractors to the Vice Chancellor, Nagaland University, it has been made clear that after the completion of work the final bill was not release by the Pro- Vice Chancellor (PVC), Nagaland University Kohima Campus (NUKC). The contractors were deprived by their right as they were ordered not to meet him in the office in regard to the contract work even though the bill was not release. Thus, the contractors were compelled to submit a letter to the Vice Chancellor, NU HQ Lumami seeking for justice. On receiving a deaf ear, the contractors on the ground that “a worker/employee have every right to receive his pay/bill if he has done his work/duty”, have stood firm seeking for their right compelling to take this untoward action against the Pro Vice Chancellor NUKC. It has been made clear under both parties that the PVC was restrained to pass through the land of the contractors yet was not stop nor restricted to attend his office vie alternate roads.

Having concern about the statement made by the NUKC, the clan does felt incertitude that,

• Why a person seeking for his right is referred to as “Miscreants”?
• On what ground the bill was not release even after completion of work. If there was unsatisfactory in regard to the work, why there weren’t any order or directive given to the contractors for completion of work.
• While other party even without half done work properly as mentioned by the contractors, was certified by the PVC and his cronies Chairman CMC and bill was released, why the bill was not release for the aggrieved contractors?
• It has been onto public opinion and view on whether the contractors did not give any percentage/share towards the PVC and the cronies and for which the bill might not release.

The clan stands affirm that counter FIR will be lodge against the concern authority and the PVC based on the aforementioned above within 48 hours on failing to withdraw the FIR lodge by the Registrar NU HQ Lumami.

Having concern for the wellbeing of the society and particularly the students and its academic sessions, the Zienuomia clan does urge the concern authority to settle the issue as early as possible so as to maintain peaceful co-existence.

Sub: Prayer for equal justice on bias done by the present pro- vice chancellor Kohima campus in respect to the construction of road leading to SET campus area Meriema

Sir,

On the subject cited above, I have the honour to bring out some few facts to your kind authority and delivery equal justice on bias and personal motive against us of the present PVC of Kohima campus. That these works were advertise vide office order NU/ENG-258/2022-1671 date 23rd Feb 2022 inviting from the appropriate class of Nagaland university enlisted contractor (civil) for these two works:

1. Mettalling, black topping and retaining wall for the road leading to SET amount Rs. 1,0041797/-

2. Resurfacing of campus road and c/o of toe wall i) To Library ii) Main road north to south Gate iii) to Mesia Hostel and Type C Quarter amount to Rs. 1,3144510/- and these were done proper tender formalities and the work were allotted to the contractors and the works of metaling, black topping retaining wall for the road leading to SET area was allotted to my firm. Based on these notice of tender and work order copy were given to dean and administrative in charge Nagaland University Vide Office order No, NU/ENG/1258/KMA/2087-1697 Dated 10th March 2023 and I have inform the NU authority and the Engineering section and stated the works. But here one point to be noted that these is newly constructed road leading to SET campus area. It is hardly five months of earth cutting and soling works were done by the another firm staring from Oct 22 to Jan 2023 even it have not cover on monsoon season period for good whether road. But we have started the work by repairing all the soiling works putting extra rock by rolling it and the works of metaling works and construction of retaining wall were finished and we apply for the first running bill and the CMC as Engineers team came and inspect the works and we got the first running bill amount to Rs. 4352673/- on 30th march 2023 in continuing of the works were have completed the whole works and submitted completion report to the present PVC and later on a letter for process releasing our final bill and suddenly the present PVC have dissolve the CMC Chairman even before expire 2years terms and sent the new CMC Chairman and his team to verify the works and resolved to not certify as the work is not satisfactory these is also to be noted basis against us. Whereas other point to be noted that the other party work of Resurfacing of the campus road C/o tow wall, i) to library ii) Main road north to south gate iii) To Mesia hostel and type C quarter as per the work order. These party have not done half the work properly done but this work have been certify by the PVC and his cronies chairman CMC and process for the release of their final bill. This is one of the main reasons of ill motives and Bais against us by the PVC and his cronies chairman CMC against us.

After that when we approach the PVC that we assured him to repair the whole portion of the road within the tenure of the defect liability period even at what cost will spend. And not on the base security deposit amount by signing undertaking. But he pointed his finger at us told us not to meet him again in his office for these matters, and now we took it as a personal ill motive against us. And now if we discus outside the office it can create any untoward incident between the PVC and us. As now we are running out of patient for this regard we are informing your kind authority to kindly look into the matter seriously and solve our case from your end before any untoward incident happen between us.
