144 CrPC imposed across the State

In view of the General Election to the 18th Lok Sabha, 2024 from Nagaland Parliamentary Constituency scheduled to be conducted on 19th April, District Magistrate, Mon, Ajit Kumar Verma, IAS issued various instructions, vide Standard Operating Procedure for last 48 hours to restrict the Assembly movement of people by invoking the provisions of section 144 of CrPC -1973.

The campaign for General Election to Lok Sabha, 2024 is prohibited before 48 hours of closing of the poll day I,e  from 04:00 PM on 17th April 2024. However, door to door campaigns during said period of 48 hours may be allowed with prior permission form DEO/AROs of the Assembly Segment.

Therefore, in order to conduct the scheduled General Election to Lok Sabha, 2024 in free, fair and peaceful manner, he invoke the provision of section 144 of the CrPC – 1973 and prohibit the following: –

  1. Assembly of 5 or more persons within the district.
  2. Movement of persons with arms/ carrying of weapons.
  3. Holding of public meetings.
  4. Shouting of Slogans and using Loud Speakers.
  5. Acting in any manner detrimental to public peace and tranquillity in the district.

The above restriction shall not be applicable to District Administration, Police, Security Forces, Law enforcement agencies, Emergency Services, Personnel/Vehicles on Election duty. All the political functionaries and party workers from outside the constituency and who are not voters of the constituency shall leave the constituency immediately after the campaign period is over.

Any violation of this order is prohibited by legal action under section 188 of IPC and other relevant provisions of the Election laws. This order is passed ex-parte  U/S 144 (2) Cr.P.C-1973 and shall come into effect from 4:00 PM on 17th April 2024 and remain in force till 20 April 2024 in the entire district of Mon.

NOKLAK

In the interest of maintaining public order in the district and to conduct free, fair, participative, accessible, inclusive and safe election to the Lok Sabha, 2024, Deputy Commissioner & District Election Officer, Noklak, Nagaland, in exercise of the power conferred under Section 144 of CrPC has prohibit: (i) Assembly of 5 (Five) or more persons in the district. (ii) Movement of person(s) with arms. (iii) Holding of public meetings.

The above restrictions shall not be applicable to District Administration, Law and Enforcement Agencies, Officials on Election duties, Vehicles on Election duty and Emergency Services.

This Order shall come into immediate effect from 04:00 P.M. of 17th April, 2024 and shall remain in force up to 06:00 A.M. of 20th April, 2024.

PEREN

Deputy Commissioner & District Magistrate Peren, Vineet Kumar in exercise of the powers conferred under Section 144 of CrPC of 1973, and in order to take precautionary measures to prevent occurrence of any untoward incidents in the interest of maintaining peace and tranquillity in the area comprising of 6-Tening AC and 7-Peren AC, has prohibited assembly of five or more persons and vehicular movement of non-essential nature w.e.f 5:00 PM of 17th April 2024 till 5:00 AM of 20th April 2024 in Peren District.

The Officials and staff of District Administration, Security Personnel, Magistrate on Duty, Medical personnel and person engage in election duty/essential services shall be exempted.

All movement of commercial vehicles (goods/passengers) or vehicles carrying essential commodities, Press & Media, Telecom services, Medical emergencies shall also be restricted from the above restrictions.

Any person violating this order shall be prosecuted under relevant Section of the Law and as the notice cannot be served individually to all concern, this order has been issued ex-parte.

TUENSANG

In view of the forthcoming General Election to the 18th Lok Sabha Election 2024 schedule to be held on 19th April 2024 as per section 126 of the Representation of the People Act 1951, the Campaign period for the Election Shall come to end at 4:00 PM on 17th April 2024.

The Deputy Commissioner and District Election Officer Tuensang A. Zibenthung Kithan NCS in exercise of the power conferred under Section 144 CrPc, 1973 has also imposed prohibitory order where by: i- Convene, hold, attend, join or address any public meeting or procession in connection with an Election or, ii- Display to the public any election matter the by means of cinematography, Television or other similar apparatus; or, iii- Propagate any election matter to the public by holding, or by arranging the holding of any musical concert or any theatrical performance or any entertainment or amusement with a view to attracting the members of the public thereto.

It further restricted:

  • Assembly of five or more persons including holding of any public meeting shall be prohibited in the District, but door to door visit may be allowed with prior permission of the DEO/ ARO of the Assembly segment.
  • All Political functionaries/ party workers/ Campaign workers who are not Voters or residence of the Assembly Constituency shall immediately leave the Constituency.

The official and Staff of the District Administration, security Personnel, Magistrate on duty, Medical personal, students traveling for examination and person engaged on election duty, essential services shall be exempted from all above restrictions.

In view of urgent circumstances, this order is passed ex- parte and shall come into effect from 4:00 PM on 17th April 2024 and remain in force till 5:00 AM 20th April 2024 in the entire District of Tuensang.
