DC Tseminyu informs on Legal Heir Certificate

Deputy Commissioner, Tseminyu, Japheth Woch, NCS has informed all the concerned that Legal Heir Certificate can be obtained from the office of the DC Tseminyu for processing of family pension/gratuity/salary arrears, GPF/Insurance claims, Ex-gratia, etc.

In this regard, the general public of Tseminyu district have been re encouraged to apply for Legal Heir Certificate for the above-mentioned purposes by obtaining a form and applying for the same. Form fee of Rs.20 and Certificate fee of Rs.50 would be charged. The following person such as the spouse of the deceased, children of the deceased sons/daughters, grandchildren of the deceased and siblings of the deceased can apply for the said certificate.

The second wife is legal heir if she is legally married, and the first marriage is dissolved through an order of divorce or the first wife is deceased. Illegitimate children are also entitled to all the deceased parent’s property rights and those are legal heirs of the deceased person.

The Deputy Commissioner also noted that a Supreme Court ruling of 2005 cited that daughters married or unmarried have the same rights as sons.

The documents required are signed Application form, Identity/address proof of the applicant, Dead certificate of the deceased, Date of birth proof of all legal heirs (Aadhar or Birth Certificate), a self-undertaking affidavit and address of proof of the deceased.

The DC also noted that Identity proof of applications can be voter’s ID, driving license, passport, PPO Book or other government issued identity card. The legal heir can be any valid identity proof/mobile bill gas bill, Bank passbook with the name and address of the legal heir or Aadhar card.
