The office of the Labour Commissioner informed all factories and establishments having 10 or more employees/workers with monthly wage threshold of up to Rs 21,000 (Rs 25,000 for Persons with Disability) to mandatorily register under the Employees’ State Insurance (ESI) Scheme.
Section 2A of the Employees’ State Insurance Act, 1948 mandates the registration of all coverable factories and establishments within 15 days of the applicability of the Act. Employers are legally bound to register their establishments and their employees under the ESI scheme once the Act becomes applicable to them. Non-compliance with ESI Act, 1948 may invite penalties/Notices under Section 85 of the Act.
With the implementation of ESI Scheme in all the 17 districts of Nagaland with effect from November 1, 2025, notified by the Ministry of Labour & Employment vide Gazette of India, dated 17th October, 2025, the Proprietors/Employers of the above mentioned factories/ establishments/institutions that falls within the operational ambit of the Act is legally required to register/enroll at the earliest. Failure to register can lead to penalties as per Section 85 of the Act.

The Scheme applies to all employees in Factories, Shops, Hotels and Restaurants, Road Transport, Newspaper establishments, Educational Institutions, Medical Institutions, Casual or contractual workers employed by Municipal Bodies, Corporations or Central Government entities (like Public Sector Undertakings), Contractors employing 10 and above workers, Implementing NGO/ Agency, Charitable Trusts and other establishments as notified.
